Azerbaijan determines legal status of Permanent Commission for investigation of aviation accidents

The legal status of the Permanent Commission for the investigation of aviation accidents and incidents is being determined, APA reports.

This is reflected in the proposed amendment to the law "On Aviation" discussed at today's meeting of the Milli Majlis (Azerbaijani Parliament) Committee on Economic Policy, Industries and Enterprising.

Note that the provisions of Chapters 4 and 5 of the Law of the Republic of Azerbaijan “On Aviation” regulate the issues of search and rescue in the event of an aviation accident, the organization of the investigation of aviation accidents and incidents, the causes of these events, and the preparation of a report on the results of the investigation. Taking into account the requirements of the International Civil Aviation Organization regarding the investigation of aviation accidents and incidents by an independent authority, it is proposed to precisely regulate a number of powers provided for in Articles 16, 17, 18 and 19 of the law.

Thus, according to the requirements of Appendix 13 to the Convention "On International Civil Aviation" dated December 7, 1944, to which the Republic of Azerbaijan is a party, member states of the International Civil Aviation Organization must establish an independent body from the civil aviation body and other bodies that may interfere with its activities to investigate aviation accidents and incidents. The relevant body must be established in a fully independent form.

Accordingly, it is proposed to add a new definition to the law to determine the legal status of the permanent commission for investigating aviation accidents and incidents.

The draft law was put to a vote and adopted in the first reading.
